Apex court refuses to refer Article 370 pleas to larger bench

Apex court refuses to refer Article 370 pleas to larger bench
, Monday, 2 March 2020 (15:23 IST)
New Delhi: The Supreme Court on Monday ruled that there is no need to refer the petitions challenging Presidential Orders, which repealed the special status of J&K, to a larger bench.
"There is no conflict between Prem Nath Kaul and Sampath Prakash's decisions, and no need to refer the matter to a larger bench," an Apex Court's five-judge Constitution bench, headed by Justice N V Ramana, said.

The Apex Court was hearing as to whether the legal issues relating to Article 370 need to be heard by a seven-judge bench or not, as some of the petitioners had cited contradictions between two previous judgement delivered by 5-judge benches in the cases of Prem Nath Kaul vs The State of Jammu and Kashmir and Sampat Prakash vs State of Jammu and Kashmir.
The Top Court bench, today, held that there are no contradictions between the two judgements. The five-judge bench will now continue to hear the cases related to Article 370.(UNI)
