Lucknow: After the Supreme Court and the Allahabad High Court flayed the Uttar Pradesh government for putting up hoardings carrying pictures and details of 57 anti-CAA protestors, the Uttar Pradesh government on Friday brought an ordinance, stating that the damages to the public property during the protest would be borne by the rioters. The decision was taken during a Cabinet meeting, held under the chairmanship of Chief Minister Yogi Adityanath, here.
Parliamentary Affairs Minister Suresh Kumar Khanna said the state Cabinet has given an approval to bring the ordinance 'Recovery of damage of Public and Private property Act 2020,' under which strict action would be taken against the people, who damaged the public property.
''The nitty-gritty of the clauses of law will be incorporated later,'' he added.
The Minister said the Supreme Court, in it's order under writ 77/2007, had asked the governments to take action against the people, who damage properties during protest. The new ordinance is in line with the SC order, Mr Khanna said.
After the Allahabad High Court had asked the state government to pull down hoardings and give a compliance report by March 16, the Yogi government had moved the Supreme Court, where the Judges asked the Solicitor General appearing on behalf of the UP Government, as under which law, the state government had put up the posters.
Government spokesman Sidharth Nath Singh said that earlier, the government had brought a Government Order (GO) regarding penalising the rioters, who damaged the government or private property during riots and this was cited, while taking action against the guilty.
''The new Act will fill in the legal and administrative vacuum, which is created time and again,'' he said.In the Cabinet meeting, the Ministers appreciated the hard stand taken by the Chief Minister against the anti-CAA protestors. However, the Minister refused to clarify whether the hoardings of anti-CAA protestors will be pulled down.(UNI)
